Liability Waiver

RELEASE, ASSUMPTION OF RISK, PERMISSION, AND INDEMNITY AGREEMENT

1. Release and Waiver of Liability

In consideration of being permitted to participate in any way in pickleball activities, including but not limited to tournaments, events, practices, clinics, open play, and court usage (collectively, the “Activities”) conducted, hosted, organized, or sponsored by Paddle Tap Pickleball LLC (“Paddle Tap Pickleball”), at the Country Club of Coral Springs located at 10800 W. Sample Road, Coral Springs, FL 33065, or at any other location where Paddle Tap Pickleball has an agreement, I hereby agree as follows:

I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, KNOWINGLY, VOLUNTARILY, AND EXPRESSLY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Paddle Tap Pickleball LLC; its owners, members, officers, directors, event directors (including but not limited to Alan Laymon and Duane Patchin), employees, agents, volunteers, officials, sponsors, affiliates, venue owners, and landlords (collectively, the “Released Parties”) FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION OF ANY KIND, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, to the fullest extent permitted by Florida law, for any injury, illness (including communicable diseases such as COVID-19), death, accident, or property loss arising out of or related to my participation in the Activities.

2. Assumption of Risk

I understand that participation in pickleball and related Activities involves INHERENT AND UNAVOIDABLE RISKS that cannot be eliminated regardless of the care taken. These risks include, but are not limited to:

  • Minor injuries such as bruises, sprains, strains, blisters, dehydration, and muscle soreness

  • Serious injuries such as eye injuries, joint or back injuries, fractures, heat exhaustion or heat stroke, heart attacks, concussions, and other serious medical conditions

  • Catastrophic injuries including paralysis or death

  • Exposure to communicable diseases, including but not limited to COVID-19

I VOLUNTARILY AND KNOWINGLY ASSUME ALL RISKS, both known and unknown, foreseeable and unforeseeable, associated with my participation in the Activities, even if arising from the negligence of the Released Parties.

3. Indemnification and Hold Harmless

I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, demands, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees and court costs) arising out of or related to:

  • My participation in the Activities

  • Any injury or damage caused by me to any person or property

  • My failure to follow rules, instructions, or safety guidelines

4. Medical Treatment

I certify that I am physically fit and have no medical condition that would prevent my safe participation in the Activities. I authorize Paddle Tap Pickleball to obtain emergency medical treatment for me if necessary and agree that I am solely responsible for any medical costs incurred.

5. Media Release and Use Permission

I grant Paddle Tap Pickleball LLC and its agents and designees the irrevocable, perpetual, and royalty-free right to use, reproduce, publish, and distribute my name, image, likeness, voice, and statements, without compensation or obligation, for any lawful purpose related to Paddle Tap Pickleball, including promotional, marketing, advertising, training, informational, and archival uses, in any media now known or later developed.

6. Governing Law and Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles. Any legal action arising from this Agreement or the Activities shall be brought exclusively in a court of competent jurisdiction located in the State of Florida.

7. Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8. Acknowledgment and Acceptance

I acknowledge that I have READ THIS AGREEMENT CAREFULLY, fully understand its terms, and understand that I am GIVING UP SUBSTANTIAL LEGAL RIGHTS, including the right to sue. I sign this Agreement freely and voluntarily and intend to be legally bound by it.

By completing and submitting this form, I confirm my acceptance of this Agreement in its entirety as a condition of my participation in the Activities.
